Welcome to DataMinder! These Terms and Conditions (“Terms”) govern your access to
and use of our services, including our web application, mobile app, and all features,
content, and tools provided by DataMinder (“Service”). By using the Service, you agree
to be bound by these Terms.
If you do not agree with these Terms, please do not use our Service.
1. Who We Are
DataMinder is an AI-assisted platform designed to simplify and automate statistical and
data analysis for students, researchers, and businesses. It is operated by DataMinder
sp. z o.o., based in Lipnowska 207 str, 09-400 Maszewo Duże, Poland.
2. Eligibility
You must be at least 16 years old to use DataMinder. If you are under 18, you must
have the permission of a parent or legal guardian to use the Service.
3. User Account
To access the app and its features, you must create an account. You agree to provide
accurate and complete information and to keep this information up-to-date. You are
responsible for safeguarding your account credentials.
4. Use of the Service
You agree to use DataMinder in accordance with all applicable laws and only for lawful
purposes. You may not:
Reverse-engineer, decompile, or attempt to extract source code.
Use the platform for illegal, deceptive, or unethical activities.
Upload data that you are not authorized to use.
5. AI and Data Usage
Parts of the Service use Azure OpenAI models to provide AI-supported functionalities
(e.g., suggesting statistical tests, generating reports, interpreting results). This means
your input data may be processed by Microsoft servers.
Microsoft’s policy states that they do not use customer data submitted to Azure OpenAI

We only share data with collaborators or third parties after obtaining your explicit
consent.
6. Free and Paid Plans
DataMinder operates on a freemium model:
Free plan: Access to basic functionalities with limited visibility of AI-generated
results.
Premium plan (€yy/month): Full access to all features, including detailed
reporting and AI assistance.
No charges are made without your explicit confirmation. You can cancel or modify your
plan at any time through your account settings.
7. Refund Policy
We do not offer refunds for partial months or unused features. However, if you
experience a billing issue or believe a charge was made in error, please contact us
within 14 days.
8. Intellectual Property
All content, trademarks, and intellectual property within the DataMinder platform are
owned by DataMinder sp. z o.o. or its licensors. You retain ownership of your uploaded
data and generated reports.
9. User-Generated Content
If you provide feedback, suggestions, or submit any content (excluding personal data or
confidential datasets), you grant us a non-exclusive, worldwide, royalty-free license to
use, modify, and incorporate it to improve our service.
10. Availability and Modifications
We aim for uninterrupted availability but cannot guarantee error-free operation. We
reserve the right to update or discontinue any feature, temporarily or permanently, with
or without notice.
11. Disclaimer of Warranties
DataMinder is provided “as is” and “as available.” We make no warranties regarding the
accuracy, reliability, or fitness for a particular purpose. You use the service at your own
risk, especially when relying on AI-generated outputs for critical decisions.
12. Limitation of Liability
To the fullest extent permitted by law, DataMinder shall not be liable for any indirect,
incidental, special, or consequential damages, including data loss, business
interruption, or financial loss resulting from your use of the Service.
13. Users Outside the EU
If you access the Service from outside the European Union, you agree that your data
may be processed and stored in the EU and with subprocessors like Microsoft (as
stated above). Your rights may vary based on local laws, but we strive to honor
international data protection standards.
14. Data Security
We implement industry-standard measures to protect the security of your data, including
encryption, access controls, and regular security audits. However, no system can be
100% secure, and you acknowledge that you use the Service at your own risk.
15. Cookies and Tracking Technologies
Our website uses cookies and similar tracking technologies to improve user experience
and analyze traffic. By using the Service, you consent to the use of cookies as

16. Third-Party Services

Upload or share malware or malicious code
Harass, threaten, or harm other users
Misrepresent your identity or affiliation
Attempt to access data not intended for you
19. Export Control and Sanctions
You may not use the Service if you are located in a country subject to EU, UK, or US
export restrictions or economic sanctions.
20. Children’s Privacy
We do not knowingly collect or process personal data from users under the age of 16
without verified parental consent. If we learn that we have done so, we will promptly
delete the data.
21. Compliance with Local Laws
You are responsible for complying with the laws of your jurisdiction when using our
Service. We do not guarantee that our Service complies with the laws of all countries.
22. Force Majeure
We are not liable for failure or delay in performance due to events beyond our
reasonable control, including but not limited to natural disasters, internet outages, war,
or government restrictions.

We reserve the right to suspend or terminate your account if you breach these Terms or
use the Service in a harmful or unlawful way. You may stop using the Service at any

The following sections shall survive termination: Intellectual Property, Limitation of
Liability, Governing Law, and any other provisions that by their nature should survive.

email or in-app messages. Continued use of the Service after such changes means you
accept the updated Terms.
26. Governing Law
These Terms are governed by the laws of Poland. Disputes shall be resolved in the
courts of Poland.
